ANALYSIS OF CONSTRAINTS IN THE IMPLEMENTATION OF ELECTRONIC CERTIFICATES IN INDONESIA WITH COMPARISON OF THE IMPLEMENTATION OF ELECTRONIC CERTIFICATES IN AUSTRALIA
Abstract
The implementation of electronic certificates in Indonesia is currently still hampered by obstacles that have not yet been resolved. However, seeing that neighboring countries have been using electronic certificates for a long time, the government issued Peraturan Menteri Agraria Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 3 Tahun 2023 tentang Penerbitan Dokumen Elektronik Dalam Kegiatan Pendaftaran Tanah. For example, Australia has implemented electronic certificates since 2011. This began with the Inter-governmental Agreement (IGA) which became a form of harmony for all Australian states to implement electronic certificates. Therefore, in this article we will discuss what things Indonesia can emulate in implementing electronic certificates. Apart from that, what obstacles are still being faced by Indonesia so that the implementation of electronic certificates is hampered. The method used in writing this article is the juridical-normative method.
